1. Agreement
By using Marina BMP — locally or with an account — you agree to these terms. If you do not agree, please do not use the software. Contact: marinaberthmanagerpro@gmail.com.
1a. Who can use Marina BMP
You must be 18 or over to create an account, and you confirm this when you sign up. If you use Marina BMP for a business, you confirm you are allowed to accept these terms on its behalf.
2. Licence
We grant you a non-exclusive, non-transferable, revocable licence to use Marina BMP for operating your marina business. You may not resell it, redistribute it, sublicense it, or reverse-engineer it. You may not present it as your own product.
3. Plans and payment
- Every new account starts with a 30-day Premium trial. No card is needed and you are not charged. When the trial ends, the account continues on the free plan unless you subscribe.
- The free version is the full product on your device: no payment and no time limit, with or without an account.
- Premium is billed monthly at a price that falls the longer you stay: €100 for the first paid month of a subscription, then €10 less for each consecutive paid month (€90, €80 … €20), and €10 a month from the tenth paid month for as long as that subscription continues. Your “streak” counts the consecutive paid months of one subscription; a price never rises while the streak lasts. If a renewal payment fails, Polar retries it and the streak continues if a retry succeeds. Cancelling stops the next renewal; Premium continues to the end of the month already paid for and nothing already paid is lost. When a subscription ends — because you cancelled, or because a payment could not be collected after Polar’s retries — the streak ends, and a new subscription starts again at €100. Subscriptions started before version 5.6 keep the terms they were sold with (€100 for the first month and €10 for every month after it). Premium adds your marina on every device you sign in to, a copy kept off your computer, and email support.
- Payment is processed by Polar. Card details are handled by Polar and never reach Marina BMP.
- The subscription renews automatically each month until cancelled.
- Prices are in EUR and include any taxes shown at checkout. We will give notice before any price change takes effect.
- You subscribe from your Marina BMP account, and checkout uses that account’s email, so your subscription always belongs to your account.
4. Cancellation
You can cancel at any time, yourself, from Account Settings in the app or from your Polar account. No email or approval is required. Cancellation stops future renewals; Premium continues until the end of the period already paid for. See the Refund Policy.
We may suspend or terminate an account for non-payment, or for use that breaches these terms or the law. Where practical we will warn you first and always give you the opportunity to export your data.
4a. Closing your account
You can delete your account yourself at any time from Settings → Danger Zone. If a paid subscription is still renewing, deleting your account first cancels it with Polar, so nothing more is charged, and Premium ends together with the account. If the subscription cannot be cancelled at that moment, nothing is deleted and you can try again. Deletion is permanent. Deleting your account also erases the marina, settings and backups stored by Marina BMP on the device you delete it from, so download a copy first if you want to keep one.
5. Your data
Your marina data is yours. You are responsible for what you enter and for having the right to hold information about your customers. You can export everything as JSON at any time — there is no lock-in, and we will not hold your data hostage. How we handle personal data is set out in the Privacy Policy.
6. Acceptable use
Do not use Marina BMP to break the law, to store unlawful content, to attack or overload the service, to attempt to access other users’ data, or to circumvent the subscription.
7. Availability
Local features work offline and are always available to you. Cloud features depend on our hosting and on your connection, and are provided on a commercially reasonable best-effort basis. We may carry out maintenance, and may change or discontinue features as the product develops; we will not remove a core capability you rely on without notice where we can avoid it.
8. Warranties and liability
Marina BMP is provided “as is”. To the fullest extent permitted by law we exclude implied warranties, and we are not liable for lost profits, business interruption, or indirect or consequential loss. Our total liability in any twelve-month period is limited to the amount you paid us in that period. Keep your own backups — the export tools exist for exactly this reason.
Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, for fraud, or for your non-waivable statutory consumer rights.
9. Changes and governing law
We may update these terms; the current version is always published here, with the date below. Continued use after a material change means acceptance. These terms are governed by the laws of Albania, without affecting mandatory consumer protections available to you where you live.
